Transactional Information

We or a designated third party may collect payment and credit card information when you subscribe to our paid Services or purchase additional services.

Third-Party Payment Processor

We do not store your credit card information in our systems. We use a third party payment processor to process payments made to us. In connection with the processing of such payments, we do not retain any personally identifiable information or any financial information such as credit card numbers. Rather, all such information is provided directly to our third party processor, Stripe, whose use of your personal information is governed by their privacy policy, which may be viewed at https://stripe.com/us/privacy.

When you access or use our Services, we automatically collect information about you.

Non-personal identification information

We may collect non-personal identification information about Users whenever they interact with our Site. Non-personal identification information may include the browser name, the type of computer and technical information about Users means of connection to our Site, such as the operating system and the Internet service providers utilized and other similar information.

Record of consents and processing activities

We store and track any consent given by you on this website in order to register, create an account, contacting us, requesting for support or sending a promo code request, etc. We keep a consents registry for users that accepted our privacy policy.

We keep a record of processing activities entitled to the owner of this website in order to be compliant with the EU GDPR article (EU) 2016/679.

BrainCert Inc may collect and use Users personal information for the following purposes:

To improve customer service: Information you provide helps us respond to your customer service requests and support needs more efficiently.

To personalize user experience: We may use information in the aggregate to understand how our Users as a group use the services and resources provided on our Site.

To improve our Site:We may use feedback you provide to improve our products and services.

Google Adwords

Using Google Adwords code we are able to see which pages helped lead to an action taken by a visitor (conversion). This allows us to make better use of our paid search budget.

Using AddThis to render social bookmark buttons in our blog posts, course, test and live class marketing pages. This allows you to be able to quickly share a post on our site to your favorite social media.

Crisp

Using Crisp CRM system, we chat with customers to answer questions and track relevant details such as the subscription information of the user, courses and other platform applications created, and the applications being used. This helps us to better serve the customers.

Canceling Your Account

You may cancel your account and you may opt out of receiving any emails from BrainCert at any time by changing the settings in your account settings page. Deleting your account may not delete all the BrainCert's data in the account to be permanently deleted from our systems and you may contact support team to delete all uploaded or created contents within a reasonable time period. Deleting your account will disable your access to any other services that require a BrainCert account. We will respond to any such request, and any appropriate request to access, correct, update or delete your personal information within the time period specified by law (if applicable) or without excessive delay. We will promptly fulfill requests to delete personal data unless the request is not technically feasible or such data is required to be retained by law (in which case we will block access to such data, if required by law).

Email Opt Out

We also email to our Customers newsletters, announcements regarding BrainCert platform and product updates, or marketing material. If you are a Customer and no longer wish to receive such emails you can remove yourself from the recipients list at any time by selecting the "unsubscribe" link provided within the e-mail footer.

Personal Information Changes

You may modify your personal information by logging in and visiting your settings at “My Account” page in the eLearning Platform or other relevant account settings page in the application specific page you are using.

If you withdraw your consent to the processing of your personal data for the purposes set out in this Privacy Policy, you may not have access to some (or any) of the Services, and we might not be able to provide you some (or any) of the Services. Please note that, in certain cases, we may continue to process your personal data after you have withdrawn consent and requested that we delete your personal data, if we have a legal basis to do so. For example, we may retain certain information if we need to do so to comply with an independent legal obligation, or if it is necessary to do so to pursue our legitimate interest in keeping the Services safe and secure.

Although BrainCert owns the platform, codebase, databases and applications, and all rights to the BrainCert platform and services, Customers retain ownership, control and all rights to their records and data which are their property.

Data Retention

We will hold your information for as long as necessary to fulfill the purposes set forth in this Policy or as long as we are legally required or permitted to do so. Information may persist in copies made for backup and business continuity purposes for additional time.

Sharing your personal information

We do not sell, trade, or rent Users personal identification information to others. We may share generic aggregated demographic information not linked to any personal identification information regarding visitors and users with our business partners, trusted affiliates and advertisers for the purposes outlined above.

Third party websites

Users may find advertising or other content on our Site that link to the sites and services of our partners, suppliers, advertisers, sponsors, licensors and other third parties. We do not control the content or links that appear on these sites and are not responsible for the practices employed by websites linked to or from our Site. BrainCert complies with the EU-U.S. Privacy Shield Framework and Swiss-U.S. Privacy Shield Framework as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal information transferred from the European Union and Switzerland to the United States. BrainCert has certified to the U.S. Department of Commerce that it adheres to the Privacy Shield Principles. If there is any conflict between the terms in this privacy policy and the Privacy Shield Principles, the Privacy Shield Principles shall govern. In compliance with the Privacy Shield Principles, BrainCert commits to resolve complaints about our collection or use of your personal information. EU and Swiss individuals with inquiries or complaints regarding our Privacy Shield policy should first contact [email protected].

BrainCert has further committed to refer unresolved Privacy Shield complaints to JAMS Privacy Shield Program, an alternative dispute resolution provider located in the United States. If you do not receive timely acknowledgment of your complaint from us, or if we have not addressed your complaint to your satisfaction, please visit JAMS Privacy Shield Program for more information or to file a complaint. The services of JAMS Privacy Shield are provided at no cost to you.

The Federal Trade Commission has jurisdiction over BrainCert’s compliance with the Privacy Shield.

Individuals has the possibility, under certain conditions, to invoke binding arbitration for complaints regarding Privacy Shield compliance not resolved by any of the other Privacy Shield mechanisms and then link to Annex I for additional information - https://www.privacyshield.gov/article?id=ANNEX-I-introduction.

We may be required to disclose Personal Information in response to a lawful request by public authorities, including to meet national security or law enforcement requirements.

In the context of an onward transfer BrainCert does not plan to transfer personal information to third parties. The provision regarding liability for the actions of agent processors does not apply because our organization will not transfer personal information to third parties.
